Should I save sweet potatoes to propagate my own?

Saving sweet potatoes to grow your own slips may seem like a great idea but its a disease risk to your garden.

Sweet potatoes have a three year life cycle and licensed propogators are bringing in disease free plantlets annually to ensure the plants being sold are disease free. 

​

Secondly, these varieties are protected with Plant Breeder Rights (similar to a patent.) As per the non propagation agreement in the terms and conditions at checkout and listed below- you can not legally save seed to propagate your own slips.

Royalty Fees: $0.01/slip

 

Payment has been made to Alberta Sweet Potatoes for slips and royalties.

The royalty payment is remitted by Alberta Sweet Potatoes to Vineland Research and Innovation Centre (Vineland) in full. Vineland reserves the right to adjust royalty fees at its sole and utmost discretion upon six (6) months’ notice.

 

Possession of seed stock of a patented variety does not constitute a right of production. Alberta Sweet Potatoes and Vineland reserve all rights, including the right to take all necessary action, legal and otherwise, to protect its patent rights in the varieties. The undersigned grower is specifically prohibited for making any use of the variety other than for production of a crop. Failure to pay an acreage fee (royalty) or saving or production of seed stock constitutes misuse and can result in forfeiture of the crop and additional legal and equitable liabilities. Any mutants, hybrids, progeny, or derivatives of the varieties; as well as any product expressed or produced by or through the use of any of the above; as well as any other material that results from, or whose derivation can be traced to, any of the above varieties shall be the property of the Louisiana State University AgCenter and is hereby assigned to LSU AgCenter.

 

By paying this invoice the terms of this agreement are hereby accepted and the customer named on the invoice warrants that they are authorized and have the authority to accept these obligations and use restrictions.

This agreement is made between Alberta Sweet Potatoes and Customer.

 

WHEREAS VSP001 or 'Radiance' is owned by the Louisiana State University AgCentre (LSUAC). Vineland Research and Innovation Centre (Vineland) is an exclusive licensee of LSUAC for the variety and is authorized to license Alberta Sweet Potatoes to sell and distribute certain plant material of the variety (“Product”);

WHERAS VSP001 or 'Radiance' is protected by Canadian Plant Breeders’ Rights number 5877;

​

WHEREAS Customer desires to enter into an agreement for the purchase of Product for the purpose of planting, growing and selling sweet potato tubers; and

​

WHERAS Product sold by Alberta Sweet Potatoes is not authorized for resale and is authorized only for the private agricultural use of the buyer. Any resale or sale of any plant, plant part, cutting, seed or root to anyone other than a bona fide sale to a food processor, consumer grocery wholesaler, consumer grocery retailer, or grocery consumer is strictly forbidden, without the prior written consent of Alberta Sweet Potatoes.

NOW THEREFOR Alberta Sweet Potatoes grants the right to plant, grow and sell Product under the following conditions:

1. No saving of seed or propagation of Product in any form is permitted.

2. Planting product outside of Canada is strictly prohibited.

3. If requested, Customer will be required to submit a Royalty Report to Alberta Sweet Potatoes no later than August 30 and pay a per acre royalty fee.

4. Customer shall allow Alberta Sweet Potatoes or Alberta Sweet Potatoes’ agents or representatives to inspect and inventory the Customer’s premises and plantings of Product at any reasonable time and upon three (3) days notice to ensure compliance with this agreement. Refusal to allow inspection shall result in the discontinuation of further sales of Product to Customer.

5. Should Customer fail, neglect or refuse any of the conditions and agreements herein contained, Customer shall be in default of Agreement. In such case, Alberta Sweet Potatoes shall have the right to authorize discontinuation of further sales of Product to Customer.
